TERMS AND CONDITIONS

IMPORTANT

Please read the following "Booking & Advisory Services - Terms and Conditions" (Booking T&Cs) carefully, as they contain important information about your legal rights, remedies, and obligations.

By making any booking for Travel Products with Us, you agree to comply with and be bound by these Booking T&Cs, which apply to any bookings you make with our consultants (over the phone or by email) as well as online bookings you make on our website.

Do not make any booking unless you understand and agree with the following Booking T&Cs and any other terms and conditions of the Travel Provider relating to the Travel Products you buy from us (Travel Provider T&Cs). You should read all the relevant Travel Provider T&Cs before acquiring Booking & Advisory Services from us.

Nothing in these Booking T&Cs is intended to exclude, limit or modify any rights that you have under the Australian Consumer Law, but we do not give any guarantee or warranty, and do not make any representation of any kind, express or implied, with respect to the use of our Website or the Booking & Advisory Services supplied in addition to those rights.

1.Definitions

"We" and "us" means Seaview (QLD) Pty Ltd (ABN 82 065 088 995), trading as Clean Cruising.

"You" or "your" means any user of our Website or any person who acquires the Booking & Advisory Services, including any person who acquires a Travel Product (whether or not the Booking & Advisory Services were acquired by you on behalf of another person or by another person on behalf of you).

"Booking & Advisory Services" means services provided by us to assist you to acquire a Travel Product from a Travel Provider and includes advisory and consulting services and facilitation of your purchase from one or more Travel Providers.

"Travel Provider" or "Travel Providers" means the company or person who provides you with the Travel Product such as airlines, tour and cruise operators, car hirers and accommodation providers. This may also include ticket consolidators and wholesalers that we use to facilitate travel with the Travel Provider.

"Travel Product" means the service or product provided by a Travel Provider, such as cruises, flights, accommodation and ground transport.

"Website" means our website www.cleancruising.com.au and associated pages and booking engines.

2.Key Terms

2.1Agency

  1. We are a travel agent. We sell Travel Products on behalf of Travel Providers.
  2. When we provide Booking & Advisory Services and once you have made a booking with us, you will have a contract with us in relation to the Booking & Advisory Services and a contract with the relevant Travel Provider(s). Subject to your rights under the Australian Consumer Law, your rights to amend or cancel your booking and any right to a refund will be governed by the relevant Travel Provider T&Cs and these Booking T&Cs.
  3. We will provide to you a summary of the Travel Provider(s) change and cancellation conditions via a summary on the itinerary. If you are not sure of the Travel Provider T&Cs or if you would like a full copy of the Travel Provider T&Cs, we will provide this to you upon request.

2.2Liability of Agency and Limitation of Liability

  1. Your legal rights in connection with our provision of Booking and Advisory Services are against us.
  2. Subject to your rights under the Australian Consumer Law, we are not otherwise liable to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including specific, direct, indirect, consequential, economic loss, incidental damages, lost profits or savings or damages for disappointment) which is suffered directly or indirectly in connection with:
    1. any failure or delay on the part of the Travel Provider or any third party in relation to the supply of Travel Products to you.
    2. any acts or omissions of Travel Providers or third parties in the course of supplying Travel Products (including any liability in contract, tort or otherwise, for any direct, indirect or consequential injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by any Travel Provider and including but not limited to lost profits or savings or damages for disappointment).
    3. any technical errors, corruption of any data, unauthorised access to your personal data, inaccuracies in information supplied by third parties, or failure to complete bookings when that failure is due to circumstances beyond our control.
    4. use of (or inability to use) our Website or any linked website;
    5. disruption to our Website;
    6. the delivery or non-delivery of the Travel Product; or
    7. any act or omission of Travel Providers or other third parties.

2.3Liability of Travel Provider

  1. Your legal rights in connection with the provision of the Travel Product are against the Travel Provider.
  2. You pay the Travel Provider (via us as the Agent) for providing the Travel Product to you. Once you have acquired Booking & Advisory Services from us, the Travel Provider will provide you with the Travel Product on the relevant Travel Provider T&Cs. Prices and availability are subject to change until your booking is confirmed and paid.
  3. The Travel Provider is the supplier of the Travel Products and is responsible for any express or implied guarantees in relation to the supply of the Travel Products. Cruise itineraries, ship facilities, cabin layouts, port schedules and inclusions may change without notice by Travel Providers.
  4. All information, including but not limited to representations that a Travel Provider makes on its brochures, relating to the Travel Provider or a Travel Product is provided by the Travel Providers or other independent third parties. We are not responsible for and make no warranty or representation about such information including the standard, class, or description of accommodation or services provided by Travel Providers.
  5. If a Travel Provider becomes insolvent or is otherwise unable to provide the Travel Product booked, your rights will be against the Travel Provider, any applicable insurer, chargeback provider, compensation scheme or other responsible third party. Subject to any rights you may have under the Australian Consumer Law, we are not liable for any losses arising from such insolvency or failure.

2.4Authority

  1. You are solely responsible for the suitability of any Travel Product that you purchase. We are not liable for any inconvenience caused or expense incurred as a result of any unsuitability of the Travel Product, subject to your rights under the Australian Consumer Law.
  2. We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking (regardless of whether other travellers have made separate payments) and that person will bind all such travellers to these Booking T&Cs and to the Travel Provider T&Cs.

3.Fees & Commissions

3.1Fees

  1. We may charge certain fees for providing Booking & Advisory Services to you. These fees represent the work undertaken by us in arranging and managing your booking and may apply where a booking is amended, cancelled or otherwise requires additional administration, subject to your rights under the Australian Consumer Law.
  2. IMPORTANT: The below Schedule of Booking & Advisory Service Fees lists all the fees charged by us. These are in addition to any Fees or non-refundable components charged by the Travel Providers (as detailed in the relevant Travel Provider T&Cs).

  1. Where we arrange air travel on your behalf, additional air booking, ticketing, servicing or administration fees may apply. The amount of any applicable fee will be advised to you at the time of booking.

3.2Commissions

  1. We may receive commissions, incentives, marketing support payments or other financial benefits from Travel Providers in connection with the Travel Products booked by you.

3.3How are funds held?

  1. Payments received from you for Travel Products will be held in our client trust account and remitted to the relevant Travel Provider in accordance with our arrangements with that Travel Provider. Depending on the Travel Product and payment schedule, payments may be remitted to the Travel Provider upon receipt or held in trust until they are due to be paid to the Travel Provider.

4.Booking Terms

4.1Availability and Changes to Travel Products

  1. Travel Products are subject to availability and can be withdrawn without notice by the Travel Provider. Travel Products may also change at any time in accordance with the relevant Travel Provider T&Cs.
  2. Subject to any rights you may have against us in relation to our supply of Booking & Advisory services to you, we are not responsible for any withdrawal of Travel Products or changes made by a Travel Provider.
  3. Prices for Travel Products are not guaranteed until you have made a booking with us and received communication from us and the Travel Provider that your booking is confirmed.

4.2Traveller Details and Booking Accuracy

  1. When you make a booking, you must provide accurate and complete details of each traveller, and according to their passport or other identification document. It is your responsibility to ensure that all details of the booking are complete and correct for all passengers before proceeding.
  2. Some Travel Providers will deny carriage if the traveller's name varies from their booking and may cancel automatically if the traveller's name is amended. This could result in the booking being forfeited.
  3. We have no responsibility for any loss or damage arising from the incorrect entry of a traveller's name or if you do not comply with the Travel Provider T&Cs.

5.Payment Terms

5.1Deposits

  1. You will be required to pay a deposit or deposits for your booking. The deposit amount varies depending on the Travel Product and lead time to travel. In some instances, full payment is required at the time of booking. We will advise you of the deposit amount at the time of booking.
  2. Any failure by you to make payment of the deposit by the due date may result in your booking being cancelled by the Travel Provider.
  3. Deposits may be refundable or non-refundable depending on the applicable Travel Provider T&Cs, the fare type, promotion or Travel Product booked. You acknowledge that some Travel Providers impose non-refundable deposits from the time of booking. Any entitlement to a refund of a deposit will be determined in accordance with the relevant Travel Provider T&Cs and your rights under the Australian Consumer Law.
  4. Unless otherwise advised, we do not impose a separate deposit requirement. Any deposit payable forms part of the Travel Product price and is collected by us as an agent for the relevant Travel Provider.

5.2Final payment of balance due

  1. Final payment must be received no later than the due date specified on your booking confirmation and invoice.
  2. Any failure by you to make payment of the Travel Product in full by the due date may result in your booking being cancelled and the forfeiture of any deposit you have made.

5.3Currency

  1. Unless otherwise stated, payments are in Australian dollars. Payments processed in a foreign currency may incur currency conversion fees charged by your card issuer or financial institution.
  2. All pricing is inclusive of goods and services tax (GST), or other such value added taxes, where applicable. Other taxes may apply upon check-in.

5.4Payment methods

  1. We accept a range of payment methods, including Visa, Mastercard and American Express credit cards, BPAY, PayID, PayTo, Clean Cruising Gift Vouchers and American Express Membership Rewards Points.
  2. Additional payment conditions may apply to particular payment methods. Further information is available on our Payment Options page.
  3. We reserve the right to amend accepted payment methods, fees and payment conditions at any time.

5.5Payment security

  1. We take reasonable steps to protect our systems and communications. However, email, SMS and other electronic communications may be subject to interception, alteration, fraud or unauthorised access by third parties.
  2. If we need to change our payment instructions, we will notify you using our usual communication channels. If you receive any communication advising a change to payment instructions or bank account details, you should independently verify those instructions by contacting us using our published contact details before making any payment.
  3. Subject to any rights you may have under the Australian Consumer Law, and to the extent permitted by law, we are not liable for any loss arising from payment scams, phishing attacks, fraudulent communications or unauthorised payment instructions where such loss results from the acts or omissions of a third party and not from our negligence, fraud or wilful misconduct.
  4. We recommend payment by BPAY, PayID, PayTo or credit card where available, as these payment methods may provide additional security protections and dispute resolution mechanisms.

6.Cancellation and Amendments

6.1Cancellations

  1. If you cancel your Travel Product, your right to a refund is subject to relevant Travel Provider T&Cs and any rights that you may have under the Australian Consumer Law. It is not within our power to decide whether you will be eligible for a refund for the cost of the Travel Product from the Travel Provider.

6.2Fees

  1. If you cancel your Travel Product, or amendments to your booking are otherwise required, we charge cancellation and amendment fees as set out in the Schedule of Fees in Clause 3.1 above. These fees reflect the Booking & Advisory Services provided by us in arranging, administering and managing your booking, including consultation, supplier liaison, payment processing, documentation, booking management and cancellation administration. The cancellation fee represents our genuine pre-estimate of the losses, costs and expenses incurred by us as a result of the cancellation. However, we will not charge a cancellation or amendment fee if you cancel or amend your booking due to a breach by us of our obligations to you, or if the cancellation or amendment is required as a result of our error.
  2. The Travel Provider may also charge cancellation and amendment fees in accordance with the relevant Travel Provider T&Cs. These fees will be in addition to the fees charged by us. We are not liable to you for any cancellation fees, amendment fees, or refusals to refund made by the Travel Provider, subject to any rights you may have against us under the Australian Consumer Law.
  3. Cancellation of a booking prior to payment of deposit incurs no fee.
  4. At our sole discretion, all or part of a cancellation fee charged by us may be credited towards a future booking. Any such credit is non-transferable, non-refundable, valid for 12 months from the date of issue and may only be varied with written approval from management.

6.3Amendments

  1. For the purposes of these Booking T&Cs, an amendment includes any change requested by you after a booking has been confirmed, including changes to names, dates, Travel Products or traveller details.

6.4Name Changes

  1. Travel Providers may treat a name correction or name change as a cancellation and re-booking and may impose additional fees or refuse the change altogether. Any costs associated with a name change will be your responsibility. Please contact us for the applicable Travel Provider rules and fees.

6.5Fraudulent Bookings

  1. We reserve the right to cancel your booking in the event we have reasonable grounds to believe it is fraudulent. In such circumstances, we will attempt to contact you using the email address you provided at the time of booking, or via your bank. In the event we are not able to contact you or your bank, we may cancel your booking with no liability whatsoever, subject to the Australian Consumer Law.
  2. In the unlikely event that your booking has to be cancelled, subject to the relevant Travel Provider T&Cs, a full refund will be made of all monies previously paid to us to the person(s) who originally paid for the booking (less any fees charged by us under these Booking T&Cs and any applicable Travel Provider T&Cs).

7.Refunds

7.1Entitlement to a refund

  1. Your entitlement to any refund will depend on the relevant Travel Provider T&Cs, which will apply subject to any rights you may have under the Australian Consumer Law.
  2. We strongly recommend that you read and understand these Booking T&Cs and all relevant Travel Provider T&Cs before making the booking. Your booking may be non-refundable.

7.2Requesting a refund

  1. Where applicable, the Booking and Advisory Services we supply include assistance with refunds. Subject to any restrictions in the Travel Provider T&Cs, you can make a request for a refund from a Travel Provider by contacting us.
  2. If your refund request is granted by the Travel Provider, the amount of refund will be the amount paid less any fees charged by us (see clause 3.1) and fees charged by the Travel Provider in accordance with the relevant Travel Provider T&Cs.
  3. If the Travel Provider is required to or otherwise agrees to provide you with a refund for the Travel Product, we will facilitate the refund between the Travel Provider and you. Once we have received the refund from the Travel Provider, we will pass it on to you as soon as practicable.
  4. Refunds are to be paid to your original payment method where practicable. Refunds will not be paid in cash.

7.3No shows

  1. If you do not check in, board or otherwise utilise a Travel Product as booked, you may be considered a "no show" by the relevant Travel Provider. No-show penalties are determined by the Travel Provider and may be up to 100% of the booking value. Subject to any rights you may have under the Australian Consumer Law, you will not be entitled to a refund from us.

8.Travel Credits, Promotions, Gift Cards and Membership Programs

8.1General

  1. We may offer travel credits, promotional offers, referral programs, membership benefits, loyalty programs and other incentives from time to time.
  2. Any such offer is subject to these Booking T&Cs and any specific terms, conditions or promotional rules published by us in relation to that offer.
  3. The eligibility criteria, value, validity period, redemption conditions, exclusions and other requirements applicable to an offer will be determined by the terms published for that offer at the time it is issued or redeemed.
  4. Unless otherwise stated, travel credits, promotional credits, gift cards and membership benefits:
    1. have no cash value;
    2. are not redeemable for cash;
    3. are non-transferable; and
    4. may not be combined with other offers.
  5. We reserve the right to amend, suspend, withdraw or cancel any travel credit, promotion, referral program, membership benefit or loyalty program at any time, subject to any rights you may have under the Australian Consumer Law.

8.2Future Cruise Credits (FCCs)

  1. Future Cruise Credits issued by a Travel Provider are governed by the relevant Travel Provider T&Cs.
  2. Any entitlement to use, transfer, combine, redeem, extend, exchange or receive a refund in respect of a Future Cruise Credit is determined by the relevant Travel Provider.
  3. Where the value of a replacement booking exceeds the value of the credit, you will be responsible for paying the difference. Any residual value of a credit will be treated in accordance with the Travel Provider's policy.

8.3Clean Cruising Credits and Promotions

  1. We may issue promotional credits, Referral Credits, Next Cruise Credits or other promotional benefits from time to time.
  2. The terms applicable to each promotion will be published on our Website or otherwise provided at the time the credit or benefit is issued.
  3. Promotional credits may be withdrawn, cancelled or adjusted where a qualifying booking is cancelled, refunded or otherwise becomes ineligible.

8.4Gift Cards and Gift Vouchers

  1. We may issue, sell or provide gift cards, gift vouchers or promotional vouchers from time to time.
  2. Gift cards, gift vouchers and promotional vouchers are subject to any specific terms and conditions applicable to the relevant gift card, gift voucher or promotion.
  3. Unless otherwise stated, gift cards and gift vouchers:
    1. are redeemable only towards eligible bookings;
    2. are not redeemable for cash;
    3. are non-refundable; and
    4. cannot be replaced if lost, stolen, destroyed or used without authorisation.
  4. Promotional vouchers issued by us may be subject to additional eligibility requirements, expiry dates, minimum spend requirements, booking restrictions or other promotional conditions.

8.5Clean Cruising Club Memberships

  1. We may offer membership benefits, rewards, credits, promotions and other incentives through the Clean Cruising Club.
  2. Membership eligibility, benefits, rewards, credits, promotions, tiers and other Club features are governed by the Clean Cruising Club Member Terms & Conditions, as amended from time to time.
  3. By joining, participating in or receiving benefits through the Clean Cruising Club, you acknowledge and agree that the Clean Cruising Club Member Terms & Conditions apply in addition to these Terms.
  4. We reserve the right to amend, suspend or withdraw any aspect of the Clean Cruising Club, including membership eligibility requirements, benefits, rewards, credits, promotions and program features, in accordance with the Clean Cruising Club Member Terms & Conditions and subject to any rights you may have under the Australian Consumer Law.

9.Changes in Price and Itineraries for Travel Products

9.1Price changes

  1. Prices for Travel Products displayed on our Website or otherwise communicated to you are provided as an indicative guide only and may vary due to peak demand periods, changes in surcharges, fees or taxes or currency fluctuations.
  2. You should check all prices for Travel Products with us before acquiring Booking & Advisory Services. The price of the Travel Products is not fixed until you receive confirmation from us that your booking is confirmed.
  3. In the event that the Travel Provider adds surcharges, fees or taxes in relation to your booking after you have booked your Travel Products with us, we will advise you of the proposed price increases. If you do not wish to incur the additional charges, you may cancel the Travel Product.
  4. In case of an obvious error (including any error in electronic labelling, error in data entry, error of calculation or clerical error) resulting in the display of a price which has obviously been displayed by mistake, we reserve the right to cancel your reservation, even if it was automatically confirmed on our Website. You will be informed of this as soon as possible. In any case, to the extent permitted by law, you will not be entitled to claim compensation from us on the grounds of the cancellation or the related costs, if any, that have been incurred due to an erroneous reservation which has been cancelled.

9.2Other changes

  1. If a Travel Provider changes any part of your booking for reasons beyond its control, for example, due to scheduling issues or overbooking we will use our reasonable endeavours to notify you. If any such changes result in your Travel Product being materially different, then you may cancel the Travel Product and we will facilitate any refund that is available under the applicable Travel Provider T&Cs, less any fees charged by us under these Booking T&Cs and at all times subject to any rights or remedies you may have under the Australian Consumer Law.
  2. It is your responsibility to re-confirm all flight departure times with the relevant Travel Provider, prior to departure. We will not be liable for any costs incurred as a result of you missing any flight due to your failure to check your itinerary prior to departure.

9.3Not included in the price of your travel

  1. Unless expressly stated in your booking confirmation, the price of your Travel Product does not include personal expenses, travel insurance, visas, passport fees, excess baggage charges, gratuities, laundry, internet access, telephone charges, beverages, room service, meals not specifically identified as included, or any government, port or local authority charges imposed after the date of booking.

10.Force Majeure

10.1Force Majeure Events

  1. Subject to any rights or remedies you may have under the Australian Consumer Law, we will not be liable for any failure or delay in providing you with Booking & Advisory Services in relation to Travel Products that is due to events beyond our control, including, but not limited to: acts of God, accident, riot, war, terrorist act, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public health crisis, civil commotion, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalised lack of availability of raw materials or energy (Force Majeure Event).
  2. For clarity, a Force Majeure Event shall not include:
    1. your (including third parties you may be booking for) financial distress nor the inability of you (including third parties you may be booking for) or us to make a profit or avoid a financial loss;
    2. changes in market prices or conditions; or
    3. your (including third parties you may be booking for) financial inability to perform your (including third parties you may be booking for) obligations under these Booking T&Cs.

10.2Refunds and Credits Following a Force Majeure Event

  1. If a Force Majeure Event occurs that affects your booking, your entitlement to a refund, credit or re-scheduled travel booking will depend on the relevant Travel Provider T&Cs and will at all times be subject to any rights you have under the Australian Consumer Law.
  2. If your booking is impacted by a Force Majeure Event and you are entitled to a refund from the Travel Provider, we will facilitate this refund to you as soon as reasonably practicable.

10.3Non-Refundable Fees

  1. Subject to any rights you may have under the Australian Consumer Law, fees charged by us for Booking & Advisory Services and any other fees listed in the Schedule of Fees are non-refundable where a booking is affected by a Force Majeure Event.

11.Your Obligations and Warranties

11.1General Obligations

You warrant and acknowledge that:

  1. you are at least eighteen (18) years old and have the power, capacity and authority to enter into a binding contract with us and the Travel Provider;
  2. you have sufficient funds to pay for the Booking & Advisory Services and the Travel Product;
  3. you have read and understood these Booking T&Cs and if booking on behalf of third parties, you understand that their booking is subject to these Booking T&Cs and all relevant Travel Provider T&Cs;
  4. the information you provide us about you and third parties is true, accurate, current and complete (apart from any optional items) as required by any registration process;
  5. you will maintain and promptly update this information to keep it true, accurate and complete;
  6. you have considered acquiring comprehensive travel insurance and we are not responsible for any failure by you to acquire adequate insurance cover;
  7. travel advice, entry requirements, visa requirements, health requirements, safety conditions and government restrictions may change at any time, and that it is your responsibility to remain informed of, monitor and comply with all requirements applicable to your travel arrangements, including by consulting relevant government authorities and official travel advisory sources;
  8. you will use the Booking & Advisory Services in accordance with these Booking T&Cs and you will not use the Booking & Advisory Services in any way to breach any laws or defame any person.

11.2Customer Conduct

  1. You agree to communicate and interact respectfully with our employees, contractors, representatives, Travel Providers and other suppliers.
  2. We reserve the right to refuse service, decline a booking request, cancel a booking (subject to applicable Travel Provider T&Cs) or cease communications where we reasonably believe a person has engaged in abusive, offensive, threatening, intimidating, harassing, discriminatory, fraudulent or otherwise inappropriate conduct.

12.Passports, Visas and Health Requirements

12.1Passports and Visas

  1. It is your responsibility to ensure that you hold a valid passport, visa, permit and any other travel documentation required for your intended travel.
  2. Visa and documentation requirements vary depending on your nationality, passport type and destinations visited and may change at any time. It is your responsibility to ensure all required visas and travel documentation are obtained before travel.
  3. For Australian passport holders, we recommend consulting the Department of Foreign Affairs and Trade (DFAT) and SmartTraveller websites at www.dfat.gov.au and www.smarttraveller.gov.au for the latest travel advice, visa information and links to relevant embassies and consulates.
  4. We may refer you to an independent visa processing provider to assist with visa applications and travel documentation. Any such provider acts independently and charges separate fees. We do not provide visa services and accept no responsibility for visa processing times, visa refusals, documentation errors or services provided by third-party visa providers.
  5. Unless otherwise stated, passports should have at least six (6) months validity beyond your intended return date.

12.2Health Requirements

  1. It is your responsibility to ensure that you comply with any health, vaccination, testing, mobility, accessibility or medical requirements applicable to your destination or imposed by a Travel Provider and that you are medically fit to undertake your travel arrangements.
  2. You should consult your medical practitioner regarding any health requirements relevant to your travel plans.
  3. Vaccination, testing and health requirements may change without notice and may be imposed by governments, ports, airlines, cruise lines or other Travel Providers.
  4. Travel Providers may refuse carriage, boarding or participation where applicable health, medical, mobility or accessibility requirements are not met. We are not responsible for any resulting loss, cancellation, denial of boarding or additional expense.

13.Travel Insurance

13.1Travel Insurance Recommendation

  1. We strongly recommend that you and any third parties you may be booking for obtain an appropriate travel insurance policy.
  2. A travel insurance policy may help cover any costs associated with cancellations, medical and repatriation expenses, personal injuries or accidents, death, loss of personal baggage or money, and personal liability insurance.
  3. It is your responsibility to ensure that you are adequately protected by an appropriate travel insurance policy.

14.Ticketing

14.1Travel Documentation

  1. Travel documentation will generally be issued once all booking requirements have been satisfied and payment has been received in full.
  2. Documentation may include e-tickets, booking confirmations, cruise documents, vouchers and other travel-related documents.

14.2Electronic Tickets

  1. Electronic tickets are used by most Travel Providers.
  2. Where electronic ticketing is unavailable, alternative arrangements will be made in accordance with the relevant Travel Provider's procedures.
  3. It is your responsibility to review all documentation upon receipt and notify us immediately of any errors.

15.Travel Provider Loyalty Programs and Special Requests

15.1Travel Provider Loyalty Programs

  1. If you wish to receive benefits under a Travel Provider loyalty, rewards, frequent traveller or membership program, you should provide your membership details at the time of booking.
  2. Eligibility for loyalty program benefits, rewards, points, credits, discounts, status recognition or other membership entitlements is determined solely by the relevant Travel Provider.
  3. We do not guarantee that any loyalty program benefits, rewards, points, credits, discounts, status recognition or other membership entitlements will be awarded.

15.2Special Requests

  1. We will communicate any special requests that you have in relation to your Travel Product(s) but we make no guarantee that the Travel Provider will accommodate them.
  2. Confirmation that a request has been passed to a Travel Provider does not constitute confirmation that the request will be fulfilled.

16.Website and Links

  1. We may amend these Booking T&Cs from time to time by publishing updated versions on our Website.
  2. The terms that apply to your booking are those in effect at the time your booking is made.
  3. Our Website may contain links to third-party websites. Such links are provided for convenience only and do not constitute an endorsement of those websites or their content.
  4. We do not guarantee that our Website or any linked website will be uninterrupted, error-free or free from viruses or other harmful components.

17.Complaints and Dispute Resolution

  1. If you have a complaint regarding our Booking & Advisory Services, please contact us as soon as reasonably practicable so that we can attempt to resolve the issue.
  2. We will use reasonable endeavours to investigate and respond to complaints within a reasonable timeframe.
  3. Nothing in this clause limits any rights or remedies you may have under the Australian Consumer Law or any other applicable law.

18.Privacy

  1. We collect, use, store and disclose personal information in accordance with our Privacy Policy.
  2. By making a booking with us, you consent to the collection, use and disclosure of your personal information for the purpose of providing Booking & Advisory Services and facilitating Travel Products.
  3. Our Privacy Policy forms part of these Booking T&Cs and is available on our Website.

19.Jurisdiction and Governing Law

  1. These Booking T&Cs are governed by the laws of Queensland, Australia.
  2. The parties submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and any courts entitled to hear appeals from those courts.
  3. Nothing in this clause limits any rights or remedies available under the Australian Consumer Law.

20.Client Acknowledgement

By making a booking with us, you acknowledge that you have read, understood and agree to be bound by these Booking T&Cs and the applicable Travel Provider T&Cs.
